    Welcome to Human Capitalists! These Terms of Service ("Terms") govern your access to and use of the Human Capitalists platform ("Platform"), owned and operated by Pnjaa Technologies Private Limited ("Company," "we," "us," or "our"). By accessing or using our Platform, you agree to be bound by these Terms.

    1. General Information

    2. Platform Usage

    • Eligibility: Users must be 18 years of age or older to access the platform.
    • Expert Eligibility: Expert onboarding is based on research conducted by the Human Capitalists team.
    • Appropriate Behavior: Users are expected to adhere to respectful and professional conduct that aligns with our mission of career and professional growth.

    3. User Data Collection

    • Profile Details: Names, email addresses, LinkedIn URLs, and phone numbers
    • Payment details for transactions
    • Profile Details (e.g., expertise, offerings, availability)
    • Session Transcriptions: We may transcribe sessions for:
      • Improving service quality and refining guidance approaches
      • Onboarding and training experts
      • Developing anonymized insights for internal improvements
      • Refund Validation: Ensuring fairness in addressing refund requests
      • AI Training: Enhancing our services via anonymized data (without personal identifiers)

    4. Data Usage

    • Purpose: Data is used for connecting users, improving the platform, and providing better career guidance opportunities.
    • Third-Party Sharing: Data may be shared with trusted service providers (e.g., payment processors, analytics services) only for operational purposes. We do not sell user data.
    • Purpose of Transcriptions: Transcriptions are used for the following purposes:
      • Improving service quality and refining interview techniques.
      • Training and onboarding coaches.
      • Developing anonymized insights for internal product development.
      • Refund Validation: Reviewing transcripts to ensure fairness in addressing claims related to service quality, including refund requests.
      • AI Training: Transcriptions may be used to train and improve artificial intelligence models for enhancing our services. This process involves anonymization to protect personal identities.
    • Rights
      • Guidance Seekers: Guidance Seekers can request suspension of transcription creation by emailing us at nishant@humancapitalists.in. Since the session transcript will no longer be available to validate refund requests, such sessions will also no longer be eligible for refunds in case guidance seekers choose to request these.
      • Guidance providing experts: Guidance providing experts may have limited opt-out options in cases where transcription is necessary for compliance, service quality, or AI training.
    • Data Security and Anonymization:
      • Transcriptions are anonymized wherever feasible to protect individual privacy.
      • Data is stored securely and accessed only by authorized personnel or systems for the purposes outlined above.
      • For AI training, all personal identifiers are removed to ensure that the data cannot be traced back to any individual.

    Opt-Out for Transcriptions: Guidance seekers can opt out of transcription by emailing us at nishant@humancapitalists.in. However, opting out will waive eligibility for refunds since transcripts won’t be available for review.


    We do not collect sensitive data such as race, gender, or health information. Cookies and analytics may automatically collect user behavior data to improve the platform.

    5. Security & Storage

    • Security Measures: Data is stored securely with industry-standard encryption and access control measures.
    • Third-Party Services: We may use trusted storage providers such as AWS and Google Cloud for data management.
    • Data Breach Notification: In the event of a breach, we will notify affected users via email within 72 hours.

    6. Payment & Refunds

    • Payment SharingExperts are paid a significant percentage of fees from career seekers.
    • Transparency: We are committed to fair evaluation of all refund requests.
    • Case-by-Case Basis: Refunds are assessed on individual circumstances to ensure fairness to both guidance seekers and experts.
    • Decision Timeline: Refund decisions will be communicated within 5 business days after submission.
    • Refund Timeline: Once approved, refunds will be processed within 5 business days.
    • Refunds may be considered in the following scenarios:
      • Expert No-Show: If the scheduled expert does not join the session within 10 minutes of the scheduled start time.
      • Technical Failure: If the platform experiences technical issues that prevent the session from taking place.
      • Inadequate Session Quality: If the guidance provided was demonstrably unprofessional, misleading, or irrelevant (subject to transcript review).
      • Incomplete Sessions: If the session ends abruptly due to unforeseen circumstances (e.g., network issues) and the majority of the scheduled time was lost.
    • Refunds will not be provided in the following cases:
      • Guidance Seeker No-Show: If the seeker does not attend the scheduled session without prior notice.
      • Late Arrival by Seeker: If the seeker arrives late, the session will still end at the scheduled time, and no refunds will be issued for lost time.
      • Change of Mind: If the seeker attends the full session but later feels the advice wasn't actionable or impactful (subjective dissatisfaction).
    • Refund Process
      • Request Submission: Guidance seekers must submit their refund request via email to nishant@humancapitalists.in within 24 hours of the session.
      • Details Required: All refund requests must include:
        • Date and time of the session
        • Reason for the refund request
        • Supporting evidence, such as screenshots, descriptions of the issue, etc.
      • Review Process: Refund requests involving session quality disputes will be evaluated by reviewing the session transcript.
      • Decision Timeline: Refund decisions will be communicated within 5 business days after submission.
    • To avoid chargeback abuse:
      • Any fraudulent or unjustified chargebacks will result in the user account being flagged or restricted.
      • Human Capitalists reserves the right to contest any disputed charges with supporting evidence.
    • Final Decision:
      • All refund decisions are made at the sole discretion of Human Capitalists, and our decision will be considered final.
    • Payment Processors:We use Razorpay, Stripe, and PayPal to securely manage transactions.

    6A. Cancellation Policy

    We understand that schedules can change. To ensure fairness and clarity for both guidance seekers and experts, our cancellation policy is as follows:

    • For Guidance Seekers:
      • Free Cancellation: Sessions can be canceled or rescheduled free of charge up to 48 hours before the scheduled start time.
      • Late Cancellation (Less than 24 hours): Cancellations made within 24 hours of the scheduled session will not be eligible for a refund, as experts reserve this time in advance.
      • No-Show: If the seeker fails to join the session without any prior notice, no refund will be issued.
      • How to Cancel/Reschedule: To cancel or reschedule, please email us at nishant@humancapitalists.in or use the in-platform cancellation option, if available.
    • For Experts:
      • Experts are expected to honor scheduled sessions. In case of an emergency:
      • They must notify the platform at least 12 hours prior to the session.
      • Frequent cancellations or no-shows may result in account review and potential suspension.
      • If an expert cancels a session, guidance seekers will receive a full refund or the option to reschedule at no additional cost.
      • Force Majeure: In rare cases of unforeseen emergencies (e.g., power outages, health issues), the platform will mediate to ensure a fair resolution, including rescheduling or partial refunds, based on transcript availability and platform records.

    Cancellation Confirmation: A session is considered officially canceled only after the seeker/expert receives a confirmation email from Human Capitalists.

    7. Intellectual Property

    • Ownership of Content: The content created during expert sessions is jointly owned by the expert and the platform, solely after the expert's consent.
    • Content Use: Users may not record, share, or reuse expert guidance without written permission from Human Capitalists.
    • User-Generated Content: By posting or sharing content on our platform, you grant Human Capitalists a non-exclusive, royalty-free license to use the content for platform enhancement and promotion.

    8. Code of Conduct

    Users engaging in the following behavior may have their accounts suspended or terminated:

    • Harassment, hate speech, or offensive content.
    • Misuse of platform data for personal or commercial gain.
    • Attempts to manipulate reviews, comments, or ratings.

    9. Dispute Resolution

    • Disputes between career seekers and experts can be reported to nishant@humancapitalists.in for resolution.
    • All decisions regarding disputes will be handled at the sole discretion of Human Capitalists.
    • Any legal disputes will be conducted under the jurisdiction of Pune, India.

    10. Account Termination

    • Users may delete their accounts by contacting nishant@humancapitalists.in.
    • Upon termination, all associated data will be permanently deleted from our servers.

    11. Cookies & Tracking

    • Cookies: Necessary cookies are used to enhance user experience.
    • Opt-Out: Users may request to opt-out of tracking by emailing nishant@humancapitalists.in.

    12. Changes to Policies

    • We may update these Terms from time to time. Users will be notified of significant changes via email.
    • Continued use of the platform implies automatic acceptance of updated terms.

    13. Limitation of Liability

    To the fullest extent permitted by law, Human Capitalists shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

    14. Indemnification

    Users agree to defend, indemnify, and hold harmless Pnjaa Technologies Private Limited (Human Capitalists) from any claims, liabilities, or expenses arising out of their use of the platform.

    15. Jurisdiction

    All legal matters arising out of these Terms shall be governed by the laws of Pune, India.
